Privacy Policy

This Privacy Policy describes how Daedalus Contrivance, LLC ("Company," "we," "us," or "our"), an Arkansas limited liability company, collects, uses, stores, and protects information in connection with FabPak Project Exporter (the "Software") and the fabpak.app website and associated pages (the "Site"). This Policy applies to all users of the Software and Site, regardless of how they access or use them.

By using the Software or the Site, you acknowledge that you have read and understood this Privacy Policy and consent to the data practices described herein. If you do not agree with this Policy, please discontinue use of the Software and Site.

1. Data Controller and Data Processors

For purposes of applicable data protection law, including the General Data Protection Regulation (GDPR) and similar regulations:

Data Controller: Daedalus Contrivance, LLC is the data controller for personal information collected through the Site and in connection with Software licensing. As data controller, Company determines the purposes and means of processing personal information it receives.

Data Processors: Company engages the following third-party service providers as data processors, meaning they process personal information on Company's behalf and subject to Company's instructions:

  • Paddle.com Market Limited — payment processing and Merchant of Record services
  • Cryptlex LLP — license activation and management services
  • Freshworks Inc. (Freshdesk) — customer support ticketing services
  • Cloudflare, Inc. — website hosting and aggregate analytics services

Where these providers act as independent data controllers for their own purposes (for example, Paddle acting as Merchant of Record and independently determining certain processing purposes for tax compliance and fraud prevention), they are responsible for their own compliance with applicable data protection law. Company is not responsible for the independent data practices of these providers. Users are encouraged to review each provider's privacy policy for information about their independent data practices.

Note regarding sub-processors: Cryptlex itself uses sub-processors to deliver its license management service. A current list of Cryptlex sub-processors is publicly available at docs.cryptlex.com/legal/subprocessors. By using the Software, you acknowledge that your license activation data may be processed by Cryptlex's sub-processors as described in that list.

2. Information We Collect

We collect information in the following categories depending on how you interact with the Software and Site.

2.1 Purchase and Transaction Data

All purchases are processed by Paddle acting as our Merchant of Record. When you complete a purchase, Paddle collects your name, email address, billing address, and payment card information directly. We do not receive, handle, or store your payment card details at any point. We receive from Paddle only the information necessary to fulfill and manage your license:

  • Your email address, for license delivery and transactional communications
  • A customer identifier assigned by Paddle, for account reference
  • Transaction records including order date, license tier purchased, and amount paid
  • Your country or region, for tax compliance purposes

2.2 License Activation Data

License activation, deactivation, and enforcement are managed through Cryptlex. When you activate or deactivate the Software, Cryptlex collects and stores on our behalf:

  • A machine fingerprint — a non-personally-identifiable hash derived from hardware characteristics of your computer, used solely to enforce single-seat license terms
  • Activation and deactivation timestamps
  • The license key and Software version associated with your activation

The machine fingerprint does not identify you personally and cannot be used to reconstruct or access information about your computer. It is used exclusively to enforce the one-machine-at-a-time restriction of your license.

2.3 Support Communications

Support requests are submitted and managed through Freshdesk. When you submit a support ticket, we collect:

  • Your name and email address
  • The content of your support request, including any attachments or screenshots you choose to provide
  • Your SolidWorks version and operating system information, if provided in your request
  • Your license key, if provided for the purpose of verifying your license status

2.4 Website Analytics

The Site uses Google Analytics 4 (GA4) to collect information about how visitors use the Site. GA4 uses cookies to collect aggregate data including page views, referring sources, general geographic region, and browser type. Analytics data collection is subject to your cookie consent choice presented when you first visit the Site. If you decline cookies, GA4 analytics are not activated and no tracking cookies are set.

Google Analytics data is processed by Google LLC. Google's privacy policy is available at policies.google.com/privacy. You may opt out of Google Analytics tracking at any time using the Google Analytics Opt-out Browser Add-on.

2.5 Information We Do Not Collect

THE SOFTWARE DOES NOT TRANSMIT YOUR SOLIDWORKS FILES, MODELS, ASSEMBLIES, PARTS, DRAWINGS, OR ANY DESIGN DATA TO COMPANY SERVERS. ALL FILE PROCESSING OCCURS ENTIRELY ON YOUR LOCAL MACHINE. YOUR DESIGN WORK NEVER LEAVES YOUR COMPUTER.

The following categories of information are explicitly not collected by Company or the Software:

  • SolidWorks files, models, assemblies, parts, drawings, or any design data
  • Bills of materials, exported DXF files, PDFs, STEP files, or any output generated by the Software
  • File names, part numbers, revision information, or custom properties from your SolidWorks models
  • Contents of your local file system beyond what is necessary to execute a requested export operation
  • Payment card numbers, bank account information, or any financial account details
  • Passwords or authentication credentials for any system
  • Behavioral data, browsing history, or any information used for targeted advertising or profiling

3. Legal Basis for Processing

For users in the European Economic Area (EEA), United Kingdom, and other jurisdictions requiring a legal basis for data processing, the following maps each category of data we process to its applicable legal basis:

  • Purchase and transaction data — Performance of contract — License fulfillment and delivery
  • License activation data — Legitimate interest — License term enforcement and fraud prevention
  • Support communications — Performance of contract — Provision of technical support services
  • Aggregate analytics data — Legitimate interest — Site improvement and user experience optimization
  • Transaction and tax records — Legal obligation — Tax and accounting compliance

4. How We Use Information

We use the information we collect solely for the following purposes:

  • To deliver license keys and fulfill purchases made through the Site
  • To activate, manage, and enforce Software license terms through Cryptlex
  • To respond to support requests submitted through Freshdesk
  • To send transactional communications, including purchase confirmations, license delivery emails, and maintenance renewal notices
  • To notify you of important updates to the Software, this Privacy Policy, or our Terms of Service
  • To diagnose and resolve technical issues reported through support channels
  • To analyze aggregate, non-identifiable website traffic data to improve the Site
  • To comply with applicable legal obligations, including tax and accounting requirements

We do not use your information for behavioral advertising, interest-based targeting, automated decision-making, profiling, or sale to third parties. We do not build individual user profiles for any marketing purpose.

5. No Automated Decision-Making or Profiling

Company does not engage in automated decision-making or profiling that produces legal or similarly significant effects on you. No decisions about your account, license status, or access to the Software are made solely through automated means without human review.

License activation limits are enforced technically through the Cryptlex platform based on the terms of your license agreement, but determinations about license compliance, revocation, or termination involve human review by Company personnel.

6. How We Share Information

We do not sell, rent, or trade your personal information to third parties. We share information only in the following limited circumstances:

6.1 Service Providers (Data Processors)

We share information with the following third-party service providers acting as data processors on our behalf:

  • Paddle (payment processing and Merchant of Record) — paddle.com/legal/privacy
  • Cryptlex (license management) — docs.cryptlex.com/legal/privacy-policy
  • Freshdesk / Freshworks (customer support) — freshworks.com/privacy
  • Cloudflare (hosting and analytics) — cloudflare.com/privacypolicy

6.2 Legal Requirements

We may disclose your information if required to do so by law or in good-faith belief that such disclosure is necessary to comply with a legal obligation, court order, or government request; protect and defend the rights or property of Company; prevent or investigate possible wrongdoing; or protect the personal safety of users or the public.

6.3 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of assets involving Company, your information may be transferred to the acquiring entity as part of that transaction. We will notify you prior to your information becoming subject to a different privacy policy as a result of such a transaction.

7. Data Processing Locations

Company is based in Arkansas, United States. The primary processing of your personal information occurs within the United States. Because we use third-party service providers, your information may also be processed in other jurisdictions depending on where those providers operate their infrastructure. If you are located in the EEA, UK, or Switzerland, your personal information may be transferred to countries that do not provide the same level of data protection as your home jurisdiction. Where required by applicable law, we rely on appropriate transfer mechanisms. You may request information about the transfer mechanisms applicable to your data by contacting us at support@fabpak.app.

8. Data Retention

  • Purchase and transaction records are retained for a minimum of seven (7) years to comply with tax and accounting requirements
  • License activation records are retained for the duration of your license and for a reasonable period thereafter for audit and support purposes
  • Support communications are retained for three (3) years following the resolution of the relevant support request
  • Aggregate website analytics data is retained for up to two (2) years

You may request deletion of your personal information at any time by contacting us at support@fabpak.app. We will respond to verified deletion requests within 30 days.

9. Data Security

We implement industry-standard administrative, technical, and physical safeguards designed to protect the information we collect from unauthorized access, disclosure, alteration, or destruction. Our security practices include transmission of all data over encrypted HTTPS connections, access controls limiting access to Company personnel with a legitimate need, and use of reputable security-certified third-party service providers. No method of data transmission or storage is completely secure. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you and, where required, applicable supervisory authorities, as required by applicable law.

10. Cookies and Do Not Track

The Site does not set cookies or use tracking pixels or similar technologies. Cloudflare Web Analytics does not use cookies or any persistent client-side storage to identify or track users. Certain third-party platforms linked from the Site, including the Paddle checkout interface, the Cryptlex license portal, and the Freshdesk support portal, may use cookies in accordance with their own privacy policies when you interact with those platforms directly.

11. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including the right to access, correct, delete, restrict, or object to processing of your personal information, the right to data portability, and the right to withdraw consent. To exercise any of these rights, please contact us at support@fabpak.app. We will respond within 30 days.

12. California Privacy Rights

If you are a California resident, you have additional rights under the CCPA as amended by the CPRA. We do not sell or share personal information as those terms are defined under California law. To submit a California privacy request, contact us at support@fabpak.app. We will respond within 45 days as required by the CCPA.

13. Children's Privacy

The Software and Site are not directed at children. We do not knowingly collect personal information from children under the age of 13 in the United States (COPPA), or under the age of 16 in the EEA and UK without verified parental consent. If you believe your child has provided personal information to us without your consent, please contact us at support@fabpak.app.

14. International Users

The Site and Software are operated from the United States. If you are located in the EEA, UK, or Switzerland, you have the right to lodge a complaint with your local data protection supervisory authority. Contact details for EEA supervisory authorities are available at edpb.europa.eu. The UK supervisory authority is the Information Commissioner's Office at ico.org.uk.

15. Third-Party Links

The Site may contain links to third-party websites or resources that are not operated by Company. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

16. Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy at any time. When we make material changes, we will update the Effective Date at the top of this document and post the revised Policy on the Site. Your continued use of the Software or Site following the posting of a revised Privacy Policy constitutes your acceptance of the changes.
